Information concerning data processing for applicants (information obligations according to Art. 13 GDPR) – Müller GmbH

We attach a great deal of importance to protecting your personal data. This is why we have provided you with the information below concerning the handling of your personal data and the rights you have with regard to our use of the data in the context of your application.

3. Processing framework

a) Duration of storage
We will delete your data six months after making a decision about an employment relationship. If you consented to your data being included in a pool of candidates, we will delete your data after a maximum of 24 months.

b) Purposes and legal basis of data processing
We use your data to justify a decision about an employment relationship and in order to contact you. If the employment relationship does not materialise, we will use your data to send you a rejection, using the same channel that you used to send us your application documents. The processing of your data is required according to Art. 88 GDPR, in conjunction with Section 26 German Federal Data Protection Act (BDSG), for the purposes of justifying an employment relationship. We require your consent according to Art. 6, para.1 (a) to include you in our pool of candidates.

c) Mandatory provision of data
The data we collect is required to justify a decision regarding an employment relationship. We cannot consider your application if the information is incomplete.

d) Automated decision-making
No fully automated decision-making processes according to Art. 22 GDPR are used to justify and implement the contract.

4. Disclosure and receipt abroad

a) Data recipients
Employees of both the HR department and the advertising specialist division receive your application documents.

b) Transfer to third countries
Data is not transferred to third countries, and there are no plans to this effect either. It may be necessary to transfer the data to an employee in Switzerland for expert evaluation.

5. Rights of the data subject

a) Right of revocation, access, correction, deletion, restriction of processing and data portability
You have the right:

  • according to Art. 7, para. 3 GDPR to revoke the consent you granted at any time. If you do so, we may no longer process your data on the basis of this consent with effect for the future.
  • according to Art. 15 GDPR to request information about your personal data which we process. In particular, you may request information about the purposes of processing, the categories of personal data, the categories of recipients to whom your data has been or is being disclosed, the planned duration of storage, the existence of a right to correction, deletion, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling, as well as any meaningful information regarding details of the same.
  • according to Art. 16 GDPR to immediately request correction of incorrect personal data or completion of your personal data, which we store.
  • according to Art. 17 GDPR to request deletion of the personal data we have stored about you, provided that processing is not necessary for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for establishing, exercising or defending legal claims.
  • according to Art. 18 GDPR to restrict processing of your personal data, if you dispute the accuracy of the data or processing is unlawful, but you refuse deletion of the same, and we no longer need the data, but require it to assert, exercise or defend legal claims, or if you have objected to processing according to Art. 21 GDPR.
  • according to Art 20 GDPR to receive your personal data which you provided us with in a structured, common and machine-readable format or to request transfer to another controller.
  • according to Art. 77 GDPR to lodge a complaint with a supervisory authority. Generally speaking, you can contact the supervisory authority of your usual place of residence or workplace or of our corporate headquarters for this purpose.

b) Revocation of consent
If you have consented to the use of your personal data, you can revoke your consent at any time with effect for the future by sending an email to processing@mueller-group.com, without this revocation of consent having any impact on the lawfulness of any processing carried out based on consent until the revocation.

Individual right of objection
You have the right, on grounds relating to your particular situation, to object at any time to the processing of your personal data based on Art. 6, para. 1 (e) GDPR (data processing in the public interest) and Art. 6, para. 1 (f) GDPR (data processing based on balancing of interests); this also applies to profiling under the terms of Art. 4, para. 4 of the GDPR.
If you file an objection, we shall no longer process your personal data unless we can demonstrate compelling and legitimate grounds for processing, which outweigh your interests, rights and freedoms; or if processing serves to assert, exercise or defend legal claims.
